This can't be intentional making the pet system more clunky than before. The restriction of not being able to command your pet independent from it's current stance makes no sense whatsoever. Could we be please be able to switch into the "Obey" stance even if no enemy mob is present?

You are. You just need to use a stance, any will do.
I put her on Obey, then on Heel, so she follows me while saving the cooldowns.
It's a little annoying to have to use it at every wipe, though. I wish this was the default.
Had the same problem. You have to target an enemy mob first, then hit Obey. After that it works fine until you resummon. This feels like a bug to me, but with all the other patch fails.. this might be new sch mechanic...
Well it seems to be the problem that after you had her on obey once. You can change the stance and will still be able to command the fairy. But if you resummon everything is greyed out until you can't use obey again (enemy mob present).

Of course it is a bug, but pet bugs are in general considered too trivial for fixing. At least that was my impression on the 10 years I waited for spirit bug fixes.
I still remember how you had to basically aggro monsters to get your pet to cast at 0 recast, or they would reset to max recast delay on assault. "Working as intended" as said by any GM I tried to convince to highlight the problem.
