The login issues and you: Why most posts here are uninformed and pointless

But people have already bought the game and despite their threats to refund, you know when the game is working properly they'll be playing and it will be as if it never happened. And after all that, we still answer to the ToS and EULA. Sad but true.

I know a lot of people that stopped considering buying this game when they heard about all the problems going on - from when they stopped selling the game to when they disabled character creation, not to mention the myriad of login problems. SE lost a lot of money on that, and there are 3 new big title MMOs coming out. Some people may "endure" playing this game right now, but it will not be many, and many yet will leave for one of the new upcoming MMOs when the time comes. If SE even tried to bring up the EULA in regards to delivered game quality, then that would piss off even more people and they would be finished, if they aren't already.

:/ No offense, but that is one of the lamest points I see people try to make. ToS and EULA "well guys. says right here in the fine print of section a paragraph 34 sentence 3 that they don't have to let you play if they don't wanna. be thankful cause you have paid for an opportunity to play this. you should be kissing their feet." Yeah every company has those rules, but we're not talking about banning anyone or people saying they own the game. No one is arguing whether or not they can or can't do that. People are getting an error that they don't know why. You said it yourself. People have paid for the opportunity to play the game. I think some of them, in fact quite a few, are still waiting on that opportunity.

The game blew up through word of mouth. As soon as the issues are fixed (issues that happen with any big MMO launch) people will come back because in the end, this is actually a pretty good game. From Legacy my highest character was 18. I paid for a lot of time but didn't use it because 1.0 was bad. Now, even with all these issues I've reached Lv. 45 on my MRD and I've had a blast with this game. I haven't even touched WoW once since it was released, even when I was unable to log in because I just wanted to play this game. I'm confident that after these issues are fixed things will be fine.

And that gives a right for people to never wonder why they are getting an error or how to correct the issue? It doesn't give another person the ability to complain that a product that they purchased from a company isn't working as it is intended too? Nowhere in your original post did you say anything about the law. Again, no one is arguing about the law. People are complaining and people are wondering why. That is all that they can do just like you said. I rest my case.

So quit getting mad at them and telling them you think they're entitled.

They may have been pointless and uninformed but had we been able to log in and play the game 98% of the people commenting on here, myself included, would have been in the game and probably never made a single comment about anything here.

You've worked with people in different countries involving what exactly? Because it clearly isn't servers. You completely missed the concept of gradually increasing server capacity to match your game sales, and I doubt you have ever seen a real server, yet alone set one up. You clearly have no idea how Sales Management and capacity planning works. Maybe SE should hire you, cause I don't think they could do any worse.

Sorry to tell you my father works for IBM and works on big systems for some of the worlds largest companies, like Duracell or Unilever (they make everything). I have def seen a server of this magnitude. This is not a little mail server you run off your mac mini.

What don't you get about people buying the game at the last minute? If a shitload of people buy my game right before my the launch or EA for this matter I only know until its too late. Its not like this has been ongoing for a month.

And if you must know I am currently importing a 20ft container from Hong Kong to NYC. I am working with artists in Italy and the Phillipines right now as well. When I had a shipping error at the last minute in HK it was already too late to respond because I was asleep when it happened and it needed to get on the boat. People need sleep. 13 hours difference from Tokyo to the east coast. 10 from the west coast.

EULA's aren't a patent defense though. Local laws can supersede them in certain instances. For instance, a major marketing point for XIV (and many MMO's for that matter) is the ability to join with your friends and play online with them. So far, SE has been failing on that promise to many. If it were to persist and become a point of contention in a class action suit, SE's EULA may not protect them if one can effectively state the case they have basically falsely advertised the product. It's not quite that cut and dry, but in the right courts and territories, this could be the case.

Something actually came up recently concerning PC Tuneup software, where there was a lot of back and forth over implied warranty, fraudulent advertising, etc.:

In the end all an EULA may do is provide a buffer in some areas, but not ironclad protection. Portions of it simply may not be enforceable in some regions due to local law.
