Except this rule seems to not be posted anywhere. Some claim its on the beta forums, but those dont even exist anymore, and a statement from a community rep does not seem legally binding. While SE could do a better job at displaying their rules that they have such a strong penalty on, there will always be people who break the rules without paying attention and doing their research.
If I'm driving down a street at 80 km/h and the speed limit is 60 km/h, but the sign was behind a tree and I happened to miss it, that does not give me an excuse to tell the officer upon receiving a ticket. It is my fault I didn't see the sign, regardless of how misplaced that sign was.
SE could have the rules displayed on every single page, including the user agreement, and people will still miss them and continue to stream. That is their risk and their problem if they are punished for it.

What is legally binding is that in the user agreement, SE can do whatever they want with your characters and your account as they own them entirely. They can ban you for little to no reason. Other MMOs also have this legal clause. If a SE rep posts that you cannot stream, and you go against their wish and get banned, SE has legal right to ban you. They can ban you if they see you stream and see you wearing a pink polka dot shirt on webcam if they want to.
Not trying to play brave white knight here, but being realistic. I do agree they need to be more clear about these issues.
