Stealing aggro'd mobs in a "kite" - do you think this is against ToS?

While farming Molting Mitelings today for Diremite Webs, there was a party in my area "kiting" the Mitelings about 8 or more at a time (they would ride a chocobo through them and gain aggro, and draw them back to the party). This of course made it pretty difficult for me to farm my mitelings, so I started attacking the aggro'd but not claimed miteling at the end of the "train" so I'd at least get one out of the spawned bunch. After about 5 minutes of this the party went elsewhere, so I'm guessing this got them a little mad. They seemed to be doing this for exp (Level 29-32 players on 37-39 mobs) but I was doing it strictly for the webs to level up WVR with a 50 GLD.

What I'm wondering is, do you think this is against the Terms of Service? Specifically this line:

"Disruptive behavior that negatively affects the experience of others or the service itself is strictly forbidden within FINAL FANTASY XIV."

Some could say I was disrupting their gameplay by killing one of their 8 in the train, but:

1) It was not claimed
2) I was able to attack it, so I feel it's free for all at that point and
3) If you're pulling 8 mobs at a time, you can afford to let someone have one.

Some may say it's not "nice" to kill one in the train, but my thoughts are that it's greedy to take them all in the first place. What are your thoughts?

No. An unclaimed mob is unclaimed. But it's common courtesy to give the camp to whoever was there first, which you never stated.

Not really, at unless they are claimed, it's free game. Now if they did claim them at you took aggro and made them return to territory so it resets aggro and then claim them yourself, that would fall under griefing and it would be against ToS.

Well, I think I was there first, but that's an interesting comment. If a sole person was there first, do they have claim over the mobs or does the party? Or if the party was there first do they have sole claim over the mobs?

only if they are doing it to purposely disturb your gameplay, griefing cant be claimed just for the sake of "not getting your way or not liking something"

I think there's about 100 places to farm mites. If there is a party trying to xp and you keep stealing targets they have obviously pulled for xp then you are in the wrong. I see you have level 50 battle class jobs. Just move and let people xp.
