Second put a disclaimer saying that you only own the original characters and story and SE owns the rest. This is what a lot of fan fictions do and they don't get sued. In fact if you write a good enough plot SE might want to use it for a game.![]()


i miss the point to do a fan fiction based on a game and sell it after on amazon... when you sell stuff on amazon it become professional, they will not sue you if it stay something like a doujinshi that sell by amateur. amazon it's not for the amateur.
There are fan fictions on Amazon for sale. Most companies let it be as a form of free advertising. I've read a lot of fan fiction that I didn't experience the source material first and because of the fan fiction I bought the source material. So, like I said before make it available for free and put in a disclaimer.
With all due respect, but if you are unable to read the User Agreement, or to ask a lawyer, then you should not try to do anything. Simply because SE clearly states that everything you will write belongs to them, not to you. And thus you are not allowed to make any kind of profit with it without their written permission. Especially since Square Enix had licensed books based on Final Fantasy XI in the past (yep, there's a series of novels on the market). And it's not only SE who can sue you, but also a licensor.

First things first, I am not an attorney nor am I qualified to give legal advice!
When there is profit to be made, it is always best to seek professional advice no matter how much advice you get from non professionals. Write to SE, ask them. Consult legal council, your hard work as an artist is worth the investment. If you cannot afford it, there are often qualified legal services from colleges and lawschools at a discount or free. These discount legal services are often given to people with low income so you would want to search for low income legal services and be prepared to disclose your income to qualify for it..
Google is your friend: There are also various "legalese" type websites, the ones with accurate info for fanfic artists concerned with licensing and this is a good place to get educated on your rights as an artist, how to keep your work and other's protected.
Another route is to not make profit, place all proper trademark disclosure info due to their perspective owners on all of your work where you borrowed theirs and just go the free route while increasing your notoriety as an artist. There is a good audience for fanfic in the non profit genre. The reward of notoriety is what you get for your invested time, not to mention practice.
That being said, if you google past lawsuits regarding unauthorized profiting from their licensed content you will find they have done so and they have every right to sue if some one unauthorized to do so, profits from their products.

yeh... your liable even with a "warning dogs" sign up and people try and rob your house and the dog attacks they can sue you its ridiculous ;x or for someone trespassing yay for the lawyers ;x

if your making money on it using anything copy written can cause a lawsuit however if you have permission or change everything to not match SE owned property then you cannot be sued however you may be asked to show the characters and areas are different to SE owned copyright
EDIT: for example think of the 50 shades of grey a popular fan fiction that sold for a lot
it was originally a fan fiction for twilight
and JK rowling had apparently released one of the Harry potter books as a fan fix to see what people would think before it was fully released

It would be great if there was a group of fanfic writers of FF14 that I could join. Been playing around with potential ideas for a while now.
