You could try and send in a ticket although I'm not too sure what they could do for you as you bought it from a 3rd party retailer.
You are pretty much out of luck in most cases. You already used the confirmation/registration code haven't you? That makes your copy useless for anyone else, plus SE didn't sell you your copy, Gamestop did. Being a former gamestop employee I feel for you and I understand, but nothing you can really do about it.
You do not state why you are seeking a refund?
There are very clear consumer rights and servers being full during an unprecedented amount of traffic is not really grounds for a refund.
Unless you have other reasons?
Theres nothing that can be done if you've used the code on your SE account. Your options are: take the freeplay time to wait n see if the issues you have get fixed, or if still unhappy you dont need to pay another penny on subcriptions if you cancel. Preferable the former of the two.
I've been trying to play this game the whole day but I can't login to Behemoth, 1017.
I have friends who are currently logged in and playing.
What is the reason behind this blatant discrimination?
Are they filtering us by IP, or maybe even Serial Key (purchased at Gamestop)?
Let's say I don't care about whatever poor-planning problems they may be undergoing, and the excuses for them, nor the ETA for resolution.
All I care about is to be able to login today, and play today. The money I've invested in this game has already gone out of my pocket. In fact, that was instant, and I did not fail to deliver my end of the deal.
Am I not entitled to play for a game I paid for? Am I being unfair?
You've obviously never played an mmo at launch. This is normal.
SE will do what they need to do and everything will be fine soon. Try and be patient.
Sadly, I am going to play this game no matter what, but I could understand how customers could be angry here. I knew what to expect and I am still freaking out. Average Joe, though, expected to be able to play immediately because they paid immediately. This man should be given his refund from SE directly.
You can QQ about it for the rest of your life unless you plan on taking SE to court due to been unable to use the product they have supplied (which will cost court fee's 4x what you have actually paid for the box) then you won't be getting any sort of cash refund, instead you will receive free days and maybe in game items as compensation.
None of the above. SE didn't realize that the game was going to be as popular as it was, and due to this the servers are overloaded with players and have made the data center unstable. To remedy this they are putting a cap on how many people can be logged at one time, but due to people AFKing while staying logged in some of that space is taken up.
SE will (hopefully) be fixing this come JP Wednesday when they add more power to the servers, new data centers and more servers as well. They are also considering implementing a AFK kickers where if a characters logged in for 'x' amount of time without movement/doing anything the server will eject this character from the server.
SE also said they are working on adding another free week of game play to everyone's account. If you wish to return the game and/or not play then I can understand and it is your choice. But if you can be patient for a few more days these issues should be fixed. As to the refund... once an MMO is opened no one will accept it back, so in that aspect you're stuck.
Legally, if you disagree with the EULA (which cannot be read until opening the box and installing the software, or redeeming the code), you are still entitled to a refund.
Problem for OP is, he accepted the EULA or he would not be reaching error 1017. So yes, OP, you are no longer eligible for a refund.
If it is really that bad for you, go outside and play with your new shiny $40 frisbee.
You are not entitled to a refund as you have opened, installed, and registered the game. Your ability to return the game to Square Enix (even if the retailer would not except) expired when you installed and registered a key.
The launch issues are annoying, but it is what it is.
Oh, and don't bring up the discrimination card. First come first serve is how the system is set up right now.

This is why Blizzard offers refunds on WoW even if the box is open. Because it begs for lawsuits that WILL be won in small claims court. Products are open all the time, and if defective can be returned.
And no, because the user agreed to the EULA does not negate a possibility of a refund. The fact is, a service has not been provided. EULAs are not far reaching legal documents that allow companies to to take money and not deliver. The beauty of small claims court is they can use their own discretion when making a judgment.
EULAs are not the word of god and the sooner people realize this, the sooner we can get back to expecting decent services and products from companies like them good old days.

All products are licensed? Whether it is licensing or ownership, you are still entitled to receive promised (implied or stated) services/product in exchange for your money. If I copied Windows and sold it, windows could respond by cancelling my license which would be fair. NOT providing me with windows after I paid, could be fraud. Licensing adn EULAs do not give companies the right to trump legal/legislated precedent

There is no discrimination. If you took 2 seconds to actually search these forums and see the thousands of other posts out there, you'd see what the problem was and tons of other players who cannot play.

You were arguing another point, make sure you stick on them rather than trying to Strawman your way into another.
Put simply, the question was can the OP get a refund? The answer is no since he opened, registered, and presumably has played (since he's level as a THM). The service is there, just getting in the door is a problem and will remain so till there is more capacity (of which they have a timeline that is fairly reasonable with compensation planned for those affected.)
It'd be a completely different ballgame if they chose to not to say anything or consider compensation.
Games are games. be it digital or a physical board or card game. Just like you expect a board to be in that Monopoly box or the Aces of Hearts, Spades, Clubs and Diamonds in that deck of cards, we expect to be able to connect to play this game. I imagine a class action lawsuit could exist if they fail to offer service or refunds.

My issues are related to this thread, but the myriad of reasons as to why i cannot log in are getting quite ridiculous. 3035s, 1017s, 2022s. there is no consistency as to why we cannot connect and use the product we paid for, and for me it's only getting worse as i actually played a bit on Tuesday and Wednesday. The game looks amazing and we want it to succeed and not have people leave because they can't be expected to wait for a product that should be working.
It is absolutely possible that a situation like this might lead to a company being legally forced to refund purchases. I sincerely doubt anything that serious will happen in this case unless the problem persists for months, but it's not unreasonable for the OP to expect to be able to receive a refund. Didn't SE actually stop selling the digital version? Do you think they did that to be nice?
