I will be canceling my order on the 30th, but not to purchase a digital copy. I will not support a company who supports a company that does business this way.
you have the order conformation receipt? if so they are obligated to produce the product you ordered. errors in overselling or any other reason doesn't change the laws regarding retail sales. the fact you bought it so long ago also means you have first come status so you get to bump any sales that came after that date to fulfill your order. you definitely need to pursue this with the store management if that doesn't work get in touch with regional.
The problem with Digital River is that they're not in a position to "GAF". They're purely a 1990's company that somehow still has business through publishers that are still living in an age where easy distribution is not only possible, but dirt cheap and without alienating their customers.
Digital River won't budge. They're the online equivalent to the DMV.
It is possible that Square Enix will help you get your copy of the game if you give them the details and are patient about it. Otherwise a new copy will achieve your goal. SE has no control over the distributors, I am sure they want them all to do the right thing but they don't have any possible way to enforce any policy with them without cause I would think but really it is a devl question, we can sympathize and conjecture but none of our comments can give you any more than some comfort I am sorry to say.
