I wonder if this means that you can get in trouble if the person you gift an item to, resells it?

They lost 2 lotus sales with me for this. one for me, one for friend. heh. The are going to lose a lot more money than they imagined I think.

They also claim it's to prevent RMT, then admit RMT can still be done (with a 72 hour delay).
The thing also says it restricts 'one time use' items but there are tons of those still giftable.

It sucks that it came to this but if they hope to reduce chargebacks from stolen credit cards they might still think it's worth it even if less people spend money on the cash shop now.

If I'm actually friends with someone, i can just ask them what mounts/emotes/minions/orch rolls they have. If i choose not to and get something they already had, that's on me. That rule seems geared more towards all the rp venues that do giveaways. Just let me spend money on my friends.

Yep. Always a case of "and this is why we can't have nice things" isn't it!

I will hope that they can put in some form of linking to check if the recipient has the mount or minion (both of these are on lodestone) before xmas. Those are fun gifts for dear friends. Emotes, I can hope they one day also fix - that's the one I like gifting most.

But surely the amount they lose in chargebacks would be lower than the amount spent on gifts of mounts/minions/emotes

That doesn't make sense either. RP venues literally give the items away with no expectation of any kind of 'reimbursement' other than 'be here and RP'.
