Is this even legal?

Early access is meant to go until launch, which was advertised as being 8/27/13. It is currently 8/26/13 and yet launch has apparently occurred with all of your previous issues still happening. I'm not sure as i'm no lawyer, but false advertisment is a crime. Not only did the majority of EA players not get to enjoy more than a few hours at most of this "early access" weekend, but now you're also going to cut it a day short? This is certainly not what one should expect from a major company, ANY major company for that matter.

I know it may be possible SE could pull some B.S. from their ToS, but this is still wronging their player base who spent extra to get a few early days, and then lose two of those days to errors and server problems which should have been fixed in beta, but then to lose that last day just because you want to launch early to make it seem like you're doing alright? Yet now many people are once more getting those errors that YOU failed to fix the last few days. please. just get your act together.

unexpected errors, so yes it's legal they've done everything they can to try to get it fixed after all

and shortening EA which is a service which is meant to be provided to us?

we probably signed a ToS or something that says, f*ck you, in so many words.... We're boned for now.

How is EA shortened? I guess it's already the 27th in some parts of the world so I wouldn't be surprised if non-EA players are beginning to show up.

It's not really shortened. I believe the EA was made available until the 30th. Most likely for those who can't pick up their copy of the game at a retail provider until later this week.

I'm absolutely furious, I pre ordered the collector's, and I have barely gotten to play in EA, not to mention phase 4 had tons of problems too. I demand compensation, and a solution to this problem, an error code is not a solution bring back the queue and limit the max population I know that people are logging out, so why the hell can't I join the line to get in? I'm disgusted, I have friends in ireland playing on my NA server (Gilgamesh) and they're in the 30s now, I'm barely in the 20s. I'm severely disappointed, four phases of beta and we're still encountering numerous problems. This isn't looking good and I'm considering a refund for my copy of the game.

@SyxFive yeah i'm sure that happened, but at least its a good game even if they're messing up their launch. We have that much at least

And even taking that into consideration, they have moved their launch date back two days to ensure their bugs are worked out ( which honestly was the best idea as it the coincides well enough with pax for them to get a HUGE amount of publicity from ) and which would give us the couple of lost days back. Then suddenly with no forewarning (admittedly this is definitely in their ToS) they move it even further up then it was originally planned

If you looked at your service account, you would see you still have 4 days of free play time. 27-26 != 4. The recompense was made. Continuing to whine because you can't play before launch because you were promised "early access" does not really help anybody, since it was not advertised as "early guaranteed to play" anyways.

That is not early access, that is barely compensation for losing that early lead that many of us paid to get. At least we'll walk out of it with something to show for it......

You guys have to understand that every MMO that has ever been launched has had the exact same sort of thing happen in the first few days. What SE is doing is a massive undertaking that is bound to run into a few snags in the first couple of days. Calm down.

Really? You're worried about a 2 day "lead" in a game that is supposed to last for years? It's meaningless.

What are you guys talking about? games release at midnight, its standard. Since its the 27th in some parts of the world the game is out and they are logging in, the rest of us who are in EA get our items. non preorder ppl still have to get their discs which they dont have til the 27th in NA. Where have you confirmed that players in NA are logging in ahead of schedule?

They did not push launch back. they extended early access meaning you are credited 3 days of game time. the game still officially launches on the 27th. http://www.belial.pt/ffxiv-early-access-extended/

So you're saying they were advertising a false product? Because they did in fact advertise that we would be able to play earlier than others, but honestly i just want this episode to be over. And I want to be able to play the game i paid for. Once i can do that i'll be happy, no sooner.

(by game I paid for I just mean that the servers work and I don't constantly get World Full errors. All I ask at this point.)

I'm implying that the case can be made that they have done their due diligence with allowing everyone to play, but between technical difficulties and the TOS you agreed to, legal action cannot be taken against them. Ultimately, little legal action can ever be taken against a service, since you can opt out of it at any time (unless you agree to any obligations on your part by way of contract). Continuing to pay for it while you feel you're being mistreated is a fruitless enterprise. The only question here is what you consider fair terms of use, or recompense.

I'd be inclined to agree if I didn't think the scale of the issues was as big as it is. We're not talking about a bit of lag or server downtime here, we're talking about absolutely packed servers that cannot handle any more traffic - and the game hasn't even officially launched yet. Combine that with FFXIV's unique track record (not good), the public and gaming journalists will have a field day trashing this game if these issues persist into launch.

I think he's referring to the announcement posted in Lodestone about the official launch, which probably served to just irritates NA/EU players even more.

Indeed i have 4 extra days on top of my 30 days from registering.

Crediting 3 Days of game time is not extending Early access, that is crediting 3 days of game play. They are similar but fundamentally different things

I'll give you have a valid point, and i'd like to point out at no point did i threaten legal action. Just questioned it's legality in regards to false advertisment.

Just going with what I've seen on their website and others online. Like I said, I believe it was made available, doesn't mean it was, but it could have been.

In essence, you did in fact pay for a game that may have servers down, and not be error-free. And if you did not want this, you had the option of a refund BEFORE, you accepted the TOS when you started playing in EA and registered your early access code

If you dont get Early Access to the game because of game errors. You have a few options.
1. Wait it out.
2. Contact support and maybe they can help
3. Contact support and ask for a refund of the difference in price for the Pre-Release version VS Regular Release version of FFXIV because even an exculpatory clause does not excuse negligence. "If not, but for the game not working, You would not have to ask for a Prorated refund."

SQUARE ENIX DOES NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE.


Speaks for itself really, this is the case for all online games.

That's not recompense. That's the "grace period" to allow for the fact that they also haven't sent out the registration codes which people are supposed to get for owning the game. That has nothing to do with compensating for the downtime; they'd do it even if there'd been no downtime, because otherwise people who had bought the game would be unable to play at launch because no one has any registration codes. (The preorder codes are, at least so far as I've been told, only for early-access and don't let you actually play post-EA except during that short grace period.)

Threads like this should just be deleted. You have no clue what your talking about.. read the terms of sale did you..or any thing? Don't worry though after today there will be MORE days just like this.

Or when the same things happen in almost every other major MMO. Its a launch for crying out loud. The only thing that really sux is their communication with us, and they are working on that a little.

I got my game registration code and i have 34 days in my account from that and the extended early access period. I'm basically giving them these 34 days to get shit together, or they won't be seeing a payment beyond this. I understand tech issues happen so I get that; still not happy about it but I won't be going around crying the sky is falling or threatening legal action.

If people are not willing to give them that time to work things out then don't register your game and get a refund if you can! or if you're suspecting you can't get a refund hold on to your game code until it looks more promising.

Actually yes, i am entitled to my complaints. Again, as a paying customer. Do they need to actually act upon them? no, but I am allowed my complaints. Also in regard to there being no negligence, how about failure to prepare for what may have been only a quarter of their possible player base? that seems pretty negligent to me

The game was accessible on Saturday(however ridiculously overcrowded), then they decided to intentionally block the majority of customers from logging in as a resolution to the instance system being unable to handle the player numbers. That's not unexpected. That's lack of preparation plain and simple.

In many industries similar behavior is illegal. Healthcare, or some utilities services for example. Entertainment and retail services really have no such mandates however, which is a same.

You should at least file a complaint with the BBB.
