Obviously you don't read before you post... I said that if someone is second in command but they have not been one of the first to join... Lets say they joined 6 months after someone else but there second in command, that implies that they don't meet criteria to have the leadership transferred... At what point did I say anything about anyone coming back and getting leadership... WAIT FOR IT WAIT FOR IT... YEAH LEARN HOW TO READ BEFORE MAKING A SNIDE COMMENT...!!!
Yeah, this would have been great for our company a month ago when your GMs and support center told me they could do nothing and I had to move an entire FC.
What would happen if there are only total of 3 FC members and they all haven't logged on for 35 days?

That list is a hierarchy of rules. It filters the potential new leader in that specific order, it doesn't just randomly pick a rule.
It would do this
1) Filter everyone who has logged in within the last 7 days -> More than 1 result? Move on to step 2. If there's only one result, that person would be the new leader.
2) Filter highest ranking members out of the results from step 1 -> More than 1 result? Move on to step 3. If there's only one result, that person would be the new leader.
3) Oldest member out of the results from step 2 is the new leader.
Option 2 is "The highest ranking member in the free company hierarchy", so the person 2nd in command (second rank in hierarchy) would be given leadership so it wouldn't be an issue. If your FC has a Leader -> Sub-leader -> General population ranking system, change it to a Leader -> 2nd Leader -> Sub-leaders -> General population hierarchy and problem solved.
