There is no discrimination. If you took 2 seconds to actually search these forums and see the thousands of other posts out there, you'd see what the problem was and tons of other players who cannot play.

Except in this case the toothbrush has no bristles, and thus I wasn't able to brush my teeth.Regardless of what you say, do or want you will not receive a refund, it clearly states in the ToS that once the box has been opened it can no longer be returned, it's like buying a toothbrush using it and taking it back saying you don't like it, they'd laugh at you.
Yes, a refund is in order, say what you will.

You can QQ about it for the rest of your life unless you plan on taking SE to court due to been unable to use the product they have supplied (which will cost court fee's 4x what you have actually paid for the box) then you won't be getting any sort of cash refund, instead you will receive free days and maybe in game items as compensation.

Legally, if you disagree with the EULA (which cannot be read until opening the box and installing the software, or redeeming the code), you are still entitled to a refund.
Problem for OP is, he accepted the EULA or he would not be reaching error 1017. So yes, OP, you are no longer eligible for a refund.
If it is really that bad for you, go outside and play with your new shiny $40 frisbee.

Sadly, I am going to play this game no matter what, but I could understand how customers could be angry here. I knew what to expect and I am still freaking out. Average Joe, though, expected to be able to play immediately because they paid immediately. This man should be given his refund from SE directly.

You are not entitled to a refund as you have opened, installed, and registered the game. Your ability to return the game to Square Enix (even if the retailer would not except) expired when you installed and registered a key.
The launch issues are annoying, but it is what it is.
Oh, and don't bring up the discrimination card. First come first serve is how the system is set up right now.
