    you can clearly see the problems arising from loot being stolen
    Loot can't really be "stolen" in this game, due to the fact that it's randomly distributed @1. While I'm not wicked fond of the current loot system, when you're playing with people you don't previously know, you have the same fair shake as they do at the loot.

    The thing is, if they were to go this route you can almost be assured that there would be a looting system involved. I would imagine instance content would have Unique/Untradeable attire, and if they kept the current "leave it where it lies" loot system, I can see this instantly becoming a large issue, especially if "random DPS A" were to obtain a shield, which "dedicated tank A" could have used. This is one of the many examples in which loot can essentially be "stolen" though yes, that's a poor word to use.
