    5. INTERRUPTION TO THE SERVICE

From time to time, in order to provide our customers with the optimal gaming experience, it is necessary for Square Enix to conduct routine maintenance on the computers and/or servers that support the Game. During these times, access to the Game or support services may be interrupted. Access may also be temporarily suspended in whole or in part, without notice, due to emergency repairs, fire, flood, explosion, war, strike, embargo, governmental action or failure to act, the act of any civil or military authority, act of God, or by any other causes beyond Square Enix’s control, or any other reasons for which Square Enix, in its sole discretion, deems that temporary suspension is necessary. You acknowledge that disruptions of service may occur and waive any causes of action against Square Enix in any way arising from or related to any such disruptions of service.
Hah, funny. EU courts struck down software EULAs as not legally binding. Many US jurisdictions do as well.

PS - it's hard to "enjoy and stop whinning(sp)" when you can't log in. xoxo.

The service is what you paid for.
I have to agree that it wasn't promised. Of course, if you paid for it, and do not receive it, that's another matter entirely, and left to the District Attorney (or Public Counsel) to deal with.

All the EULAs in the world won 't stop a customer from walking away when they don't get what they paid for. Sure, they can't sue now, but they'll take their business elsewhere. Once the game goes live and people can't play, say goodbye to the potential player base. If it goes on long enough, say goodbye to the game's reputation and watch it join the ranks of Vanguard and its ilk.

Yup, most US courts will rule in the favor of the customer for one reason. It was within their control to prevent this non-service from happening but because of poor planning and misguidance this is the result. So by their definition in the EULA to me they broke that contract between us and them.

Except for the fact that they have not suspended services as a whole. They have only suspended services in part. In other words, everyone pays the same amount for the service but only a small number are receiving the service they paid for at any give time and no one is receiving a reasonable service for what they paid.
