I have to agree that it wasn't promised. Of course, if you paid for it, and do not receive it, that's another matter entirely, and left to the District Attorney (or Public Counsel) to deal with.
All the EULAs in the world won 't stop a customer from walking away when they don't get what they paid for. Sure, they can't sue now, but they'll take their business elsewhere. Once the game goes live and people can't play, say goodbye to the potential player base. If it goes on long enough, say goodbye to the game's reputation and watch it join the ranks of Vanguard and its ilk.a nice paragraph from EULA you and everyone else accepts before actually playing the game. Yup, most US courts will rule in the favor of the customer for one reason. It was within their control to prevent this non-service from happening but because of poor planning and misguidance this is the result. So by their definition in the EULA to me they broke that contract between us and them.
Except for the fact that they have not suspended services as a whole. They have only suspended services in part. In other words, everyone pays the same amount for the service but only a small number are receiving the service they paid for at any give time and no one is receiving a reasonable service for what they paid.a nice paragraph from EULA you and everyone else accepts before actually playing the game.
