He actually cannot take his payment back.. depending on when he bought it. Most card companies would question him then go to the 3rd party which would be SE, they did nothing wrong, he actually signed the ToS and got what they said they would provide to him.
He could get a refund straight from them, he's only preordered the game. Again, it hasn't been released. If he was feeling extra mean, he could charge back, and there's nothing SE could do about it.

SE *could* conceivably sue the person doing the charge back. Odds are they won't, as it won't be worth the time trying to convince the cops that it's worth their time. But it could happen.
No they can't, as long as he does it before the 27th he's in the clear. If they won't offer him a refund on his pre-order (Not the released game) he's well within his rights to do a chargeback.

Depending on the credit card company, they'll issue a refund and then go after the vendor for a refund. But in the mean time, the vendor (SE) will very likely ban the guy's account at a minimum.
Depends on many things. Something like this *COULD* wind up being a strike against somebody's credit, so it could matter a lot.
Hi white knights! Have you seen your real lives lately? No? I see...Honestly Abatement, SE is trying to fix the problems... Its just they game has small windows off maintenance. Honestly SE will probably say no and how could you stop the payment? It was already sent to them. Just take a break and go play a shooter or something. These pointless threads are well pointless. Maybe SE is reluctant to post anything that may not be 100% true? Maybe they are just trying to focus on whats more important... maybe fixing the game/login issues.
