1.0 non legacy can't play in early access?

So from the looks of it unless you preorder the game now or paid for 90 days back in 1.0 you can't get into early access. But if you bought 1.0 you don't need to buy the game again. So squareenix wants to alienate anyone from 1.0 that didn't play for 3 months unless they spend more money now on a new version.

Why is there such a limitation and why not just have early access to anyone with a valid copy of the game.

I think that the reason Legacy is getting EA as well is kinda of compensation perk for supporting the game in the past, just like the separate servers and the locked in lower sub rate.. :\
