Yoshi P understands that they cannot possibly do everything the players want as far as glamours go and his compromise was to turn a blind eye to mods so long as modders were reasonable and didn't behave irresponsibly. I called it "The first rule of fight club is don't talk about fightclub" agreement because he was willing to let players use them so long as they didn't do so in a way that forced him to follow through on the game's policies in an official capacity.The problem with that reasoning is that since everything is clearly laid out in the TOS yet nothing is done consistently in its application, from crackdowns on mods, cheats or even milder things like ingame harassment or toxicity, then we're left with people essentially left in the dark as to what are their true policies. Not that it excuses or justifies breaking the actual TOS, but what matters is the policies used in application which are what define the actual rules, not the written TOS, if both are worlds apart like they are.
Edit: also, just food for thought, the more you crack down on something illegal, the more underground you push it, and the more unsavory that something will become.

Right? In situations like this I always think about an interview I saw with one of the WoW devs. Talking about feedback and community trends and such, he said something along the lines of, "If 'everyone' knows about something, you can be sure that also includes the dev team."

But it actually is Square Enix's fault mutually as it is the community.
Square Enix have created a situation where they are wanting all of the upsides of modding, yet none of the downsides of it, and this just ain't practical. The ToS effectively amounts to a land of the lawless, and at some point it will run rampant. (Already has, and it will again), because the ToS itself is silly, as is the actual enforcement of it.
I am not just talking about Mare here specifically, but even the development, e.g., we actually saw plugins that enabled stalking due to their complete inaction... Plus, we talk about "Don't talk about fight club" - But this isn't really the way it works at all lol, this community is very loud with modding in general, it just so happened that Mare ended up being the loudest.
Even as it stands now, really.. It's actually only speculation whether this situation is due to how loud it was, or whether it was due to another reason, e.g., security concerns, or concerns about it utilizing the same account IDs that a certain other plugin did. Them taking down the tool is a big deal, but it is also simultaneously a nothing burger. Why? Because we will see a new one after everything has settled, and then we'll be back at step one again because they've technically not actually enforced their ToS on the players.

The alternative to a blanket ban on any mods in the ToS is the company adding its own API that has the ability to interact with the game client under certain conditions.
I don't think the mod community actually wants this, because:
- You will be limited only to the API commands allowed by SE
- You will be required to register your third party app with SE (as a developer) to get access to a token/key system for authentication against the main app
- Once they add a specific set of API commands then they'll go down 10 times as hard against anyone they find circumventing it
- They will almost assuredly limit those commands to only allowing read rights to log files or the character list on the Lodestone, or write updates to certain .DAT files for the UI - not any of the character or emote files
- Update files to other user's systems will most likely be prohibited
- Access to the encrypted character list will most likely be prohibited
