This is somewhat similar to a speeding ticket in my opinion. Ever been in a group of cars that are all speeding and you're the only one that gets pulled over? Everyone else breaking the rules doesn't make you suddenly innocent. Obviously there's more factors, but I don't see you getting out of the name change.
