SE's excuse is then the tea club that deal with the reports and all manner of...whatever they deal with, would no longer have a reason to go to work.

the TOS is never the problem, if people behaved better with others, there would be virtually no need for a ToS, no matter how much you thinks its restrictive etc, its there for a single reason, people are ....well, fill in the what they are. but if people werent people, we wouldnt need the ToS, so that falls on the shoulders of the others that we play with in any mmo. (not singling you out Raoabolic, just commenting on the comment before about the "restrictive" ToS from someone else)
