I think the best way to "prove" the innocence is by reviewing chat logs.The question is: when it's an online environment, just how certain can one adult be that the other person is also an adult?
If the other person is a minor and the interaction gets reported, it could be difficult to convince law enforcement (and a jury if things go that far) that you were 100% unaware that they were a minor.
if it comes to that, that is, and Law enforcement starts investigating the case, they're legally compelled to investigate every little detail. now im not sure if SE would provide full chat logs of a player.
but yeah, that's a pretty good way to prove one's innocence.
I'd say its easier to do that online, as everything is recorded, compared to irl where if you meet someone in the club and they say they're 19, but turns out they're 17, you'd find it harder to prove your innocence.
I don’t get it. I’ve read through some of the rebuttals, and I just don’t get it. Either some of you are trolling in response to what you already believe is a troll post, or you generally believe that ERP belongs in FFXIV.
No where in this entire thread have I said that ERP is inherently wrong. I have said that there is a place for it, and that place is not in a video game marketed to consumers of all ages.
Your behind closed doors argument, your let people do what makes them happy argument, and your don’t partake if you don’t like it arguments do nothing to refute what I am saying. You have two options because this topic really IS black and white:
1. You believe ERP and by definition cyber sex belongs in FFXIV
2. You believe that behavior belongs in other platforms more appropriate for their user base
Telling someone to grow up does nothing. I personally believe some of you are culprits which is why you react the way you do. I realize I’m essentially yelling at a brick wall, but hopefully one-day SE will take actual action against this. However, considering Japan produces some of the most perverted media known to the world in the form of anime, it’s unlikely.
It's not strictly an internet problem.
Most real world laws and regulations that restrict what a person is able to do were created because a minority of individuals could not be trusted to act within the bounds of common sense and self-restraint.
If they can't be trusted in real life, there's even less chance they can be trusted on the internet where there's frequently a measure of anonymity to hide behind. Thus laws and regulations start getting spread to online interactions as well. It's easier to blanket ban 100 things under a single rule than to make up 100 rules to cover each of 100 different situations.
Yet that's still an incredible ordeal to have to go through, with the possibility of job and relationships being at risk even when someone is innocent. When it comes to such accusations, many take a hardline "act now" stance to distance themselves from the accused. Is it worth the risk just for a chance to talk dirty with a random stranger online?
Common sense would say no, but it's ultimately up to the individual.
I'm fine with people doing what they want in private. Any risk is theirs alone. But don't do it in a place where others can witness it. You don't know who's watching.

Issue is people that engage in this stuff have no idea if the person they do this with is a child or not.
In some countries prosecution could even occur. Good luck telling the police you didn't know - it won't wash.
It "will wash" if you can prove the person you were talking to wasnt a child, and you can prove that via chat logs.
if you didnt ask someone their age, that's on you of course.
but if you did, the fault is not yours.
