If you don't like being target for violating TOS...how about don't violate the TOS?

It is not a question if should. Point is if SE wants to ban people for such a thing they can. A broken rule is a broken rule and comes with inherent risks. Why is that so hard for people to understand? Sure certain rules are dumb but nevertheless, one should not be shocked if they get introuble for breaking an agreement which is the ToS. We can whine and cry about how it is unfair but let us be real it is clearly written in said ToS.

As I said point is SE is well within their rights to ban people for such things. You can disagree with the rules but rules are rules.
