This is a misunderstanding of my position and the totality of communication. The communication hasn't been strictly "THIS IS AGAINST RULES DO NOT DO IT" its been much softer to the point of the takeaway being: "Don't harass people, don't actively advertise it, and we will leave you alone"

seems pretty "THIS IS AGAINST THE RULES DONT DO IT" to me. that isnt soft, it isnt ambiguous.. thats him saying... "just dont do it, period..."

so really, there is no position that you are advocating which is defensible. sorry.

A ban will never be better than a warning.
In no situation has putting someone directly into jail without a trial ever been considered fair.
Strikes should always add up to bans.

To me, this is pure brute force.
The ToS' grey areas are grey probably for the pure fact that SE and the GMs can interpret it and the punishment as they see fit.

Also, if an area is grey and not strictly defined and up for interpretation on the producer's part but not for the consumer - then the punishment of being banned for a service you are paying for (which again has no clearly defined rules and also has a social rule that is "don't ask don't tell") is completely unfair especially moreso if the account has never had a strike. We blame a consumer for grey interpretation that is the fault of the producer ? The rules are grey for a reason.

I believe the rules to be grey because of the way they historically enforced them. It just seems steep to ramp up suddenly to 10 day bans on accounts that have had no GM interaction at all. (For this type of infraction. It's not like the pvp cheaters, gathering botters, etc.)

It's a 10 day suspension. Aka strike 1.

AFAIK it goes L1, L2, L3 -> Caution, Warning, then Suspension.
Even then suspension level 1 is only 3 days. 10 would skip straight up to a level 2 suspension without caution or warning.

They are in the right to go as heavy handed as they want to.

Yep, they have themselves to blame here. On the flip side of this, SE has been very hands off on this, even allowing a world first race to stream with ACT a couple of years back while Yoshi P watched. My point is, they should have been more proactive on this from the get-go instead of letting things get so out of hand. The ToS can say whatever SE wants, but if SE doesn't have the desire to act on it...well, we have situations like this.

I believe you have to agree to the terms of service to play the game so if they weren't aware of the rules, that's on them. Doesn't matter how new they are.
