I like using them when you're moving into enemy territory but it's annoying in like the sharlayan map to be right on top of it at the start of the encounter trying to help burst down the point only to have a NIN or melee zoom past you from the opposing team to pick up your potion so they can then wail on you.
1) The potions do work like the fire orbs. The only reason you have to stand under them for a bit to pick them up is server ticks. Both are "instant pickups" otherwise.

2) The reason you can't pick up potions at full health is most likely to prevent trolling and/or tilting your teammates by "wasting" them. The fact that it's possible to guarantee you get the potion in a 1v1 by not attacking your target is a heads-up play and I'm glad it's possible, because it's completely contrary to what you'd expect normal "optimal" play to look like and it's still the right play to make in certain circumstances.
