That's not how it works. Anyone could write a ToS but it doesn't stand in court if it's not within the legal framework and this is proven time after time. They could have changed the terms, yes... But they didn't in the duration of the event so they have I believe 2 weeks to resolve this after the event ended to not breach their side of the agreement. Once their side is breached, then they could be brought to court over this. It's just an emote but we all did have to pay a decent amount of money for this "Scam". They know better (hopefully) and will likely issue codes to anyone who asks at some point to avoid this outcome even if it costs them money for each code generation. I'm guessing because they would lose in court pretty easily if it came to it. I'm not a fan of court things and would rather they just send the codes out to everyone who ordered grubhub for the duration of that event and call it the day.
