How can it be that virtually every other online game out there has a way to detect and ban people using third party software? Of course there is a way for them to know. They have just thus far chosen not to know.

Because Yoshida explicitly said during his speech about ACT that scanning our PCs is illegal. Lest you forget, SE is a Japanese company located in Japan, and they have different laws to abide to.

"We cannot do anything, if people have a little window on their screen showing ACT. We don't want to "scan" your computer for the software you have installed, that's against the law anyway. There are additional plugins for ACT that influence game play a lot, this is breaking game balance and is target of more severe penalties"

That being said, you still don't need to worry about mods and 3rd party tools even if they are there. No one can force you to use them, especially considering they're against the ToS. If you see people demanding you to or harassing over not using/doing something 3rd party tool related, especially in game chat - report, you have full right to do so in this situation.
