there would be all new servers so everything would be fresh, first come first serve.
Probably will be closed off for some time but there will be many houses to grab. When Twintania on Light was new it was closed for purchase for some time, to be open for FC first then couple months later open for personal purchases.
what i mean is, he is leaving the server to go to OC Data center, and i would like to buy HIS house on my server for gil is that a problem?
There is no player to player direct transfer of housing for private plots. FC plots have a work around by inviting the person then transferring Master to the new person.
When his plot is vacated it will go on the cooldown timer the same as any other plot. If you have a house already you can relocate to it at that time, otherwise you'll need to wait the timer out. At best, you'll have an advantage on knowing the timing for the plot but thats no guarantee of getting it; by timing I mean you'll know when the timer starts so you can estimate when its most likely to be free of the timer better than others who won't know. The timer window is 24 hours but most plots are released in the 8-16 hour range.

It's not against tos.
It's also not possible to do.
You can give him 200M to vacate the plot, then the plot would go on the purchase timer. At that time anyone can relocate to it or purchase after the timer expires.
There is no way for him to sell to you where ownership goes straight to you.
There is no to transfer ownership of a personal house. You will have to go through Housing Extreme to get their house.

Is the house a private house or an FC house?
If it is a private house there is no way to facilitate a sale from one player to another. You could give gil to your friend but still will not own the house. When a plot is abandoned the house and all of its items are removed so all that remains is an empty plot. To buy the plot you are in a race with other players to see who can click the lot plaque first after it becomes available for sale. To make it even harder no one knows after a house is abandoned when it will become available for purchase from the system so you would need to camp the plot to have chance of winning the click race.
If it is an FC house and your friend is the FC Master they can make you the Master and you will then own the house. In this case it is up to you whether you want to donate gil to them or not.
I believe those are usually FC houses where RMT sellers buy multiple FC houses then sell them to other players by making the purchasing player FC Master. There is no guarantee they will fulfill their end of the bargain though.
There are also RMT people who for a price will ask for your userid and password to setup housing bots on your account in order to buy a personal house. This breaks multiple areas of TOS. Here it is any one's guess whether they will steal your account or get it banned for using bots. Even if they are legitimate you should never let anyone else know your userid or password (a TOS violation in itself should you do it knowingly).
