    Not nessicarily for FMLA, some companies if you have the PAID TIME OFF will still pay you until there is no more PTO. Afterwards you won't get paid. All FMLA basically does is makes sure that the company doesn't fire you for not working due to having to take care of either yourself or a close family member for medical reasons. (Had FMLA myself when my mother was still alive due to her congestive heart failure near the end and the company did pto/vacation time and used it when i had it.)

    The FMLA only requires unpaid leave. However, the law permits an employee to elect, or the employer to require the employee, to use accrued paid vacation leave, paid sick or family leave for some or all of the FMLA leave period. An employee must follow the employer’s normal leave rules in order to substitute paid leave. When paid leave is used for an FMLA-covered reason, the leave is FMLA-protected.

    This all started on 5/2/24, after despite my better judgement, I let myself be convinced to come back into work despite still being sick. 5/3 is when I went into work to get the papers to make sure I wouldn't lose my job and had them filled out by the hospital. The only question I was asked by the lady was if I wanted to do it partial or the entire 6 weeks, to which I told her I would rather be there for my mother so she doesn't have another fall.

    What's funny about it is that I've actually gone back and checked my bank statements plus having talked to my boss earlier about this last week (the physical therapist last week wasn't satisfied with how my mom's knee was healing and I overheard her saying she might be in the splint for two more weeks, which is why I went to go check and found all of this), but also I'm 101 hours in the negative. He also tried to put me back in early when the form clearly stated I could return to work on 6/14. I had to go in that day and ask him as to why this was so badly mucked up.

    "Oh, I never saw your papers." Even though that apparently got filed away in the other office for all of the managers to access. I even had told the managers that were in your office to leave it on your table, to which they did.

    If I were to get paid, it could have instead come from my sick leave as due to our company's PTO changes, we're no longer able to accrue the hours (according to some of the managers, the sick leave will be completely erased by the end of this year), and now everything is in PTO that you have to earn over the course of the year. It sounds good on paper but doesn't quite make much sense at all when it comes to unplanned leave like what I am going through. Worst possible outcome from what corporate told me is that I will end up OWING my company money, which is utter horseshit. If it did come down to that, I would owe a little under $2,800.

    The PTO does not roll over into next year, so it has to be used up before the end of the year. And you can bet your booty that November and December time off are always off the table in this company.

    "Oh, these new PTO changes will be great for everyone! But you have to work long hours to earn the time off! Oh, you don't have any time off and we paid you anyway? Prepare to bend over "

    it really sucks don't it. I do hope you can get somethings worked out but I don't think you'll get the paid time off back since it was already used. most likely due to your company policy. =(

    I'm just hoping I can get this sorted when I go back in tomorrow to talk to my boss.

    It's funny. I've been working for this company for about 18 years. I've been basically watching this company change for the far worse in favor of the company itself. Their hiring practices are awful, they're now putting in minors into departments, and basically we're having to babysit them with the knives and deli slicers. The youngest is apparently 15 years old, which is a massive no-no as our machinery will cut off limbs if misused yet they're allowed to clean it.

    If I can't get it sorted out tomorrow this might be my sign to retire from this line of retail.

    definitely wish you good luck with it though. If you have an HR you may have to go through them too but still good luck completely =)

    So got done speaking with my boss. My company won't go back on giving back the PTO they took for my FMLA leave as it's already been paid out. The only good thing I still have left is 1 week left of PTO from working this long at the company plus 2 weeks of holiday pay, which I was told they did away with a long while ago. As for the negative, they've no idea how they're going to sort that out unless it means I'm stuck working for free for two weeks.

    So yes, I'm screwed because management doesn't know wtf they're doing when it comes to unplanned leave. I think this is my sign to leave.
