Hate speech isn't even recognized as a legal term in the US as most things that would be considered hate speech are legally protected by the First Amendment.I have seen other instances where a Japanese video game company would either ban in-game chat (think of how hard it is to have voice chat or send messages to people with Nintendo Switch Online) or remove the online forums entirely if they were consistently abused.
Would we reach the point in FFXIV where there is no longer a Novice Network? Would that be the only way to stop the problem? If this awful person can continually make alts and jump worlds and evade an IP ban & payment method ban, I don't see any other way to stop the toxicity.
As somebody else mentioned, we take hate speech & hate crimes seriously in America. If this were to blow up on social media, Square Enix would have quite a headache on their hands! In their defense, I don't see a way to fix the problem, other than removing the NN for some worlds or all worlds.
False. If you walk up to a person of color and call them the N word you can and most likely will be charged with something. It may only be a misdemeanor and forced community service, but hate speech is NOT protected by the 1st amendment.
Well it is not 100% false "hate speech" is not a legal term. Also while no legal expert I do think one could make an argument that if the comments are not a direct face-to-face obesities or harmful speech that is not a threat could be argued protected under free speech.
I do know the supreme court has deemed most what people would consider hate speech not protected but I do think the cases of that ruling were cases of direct insults or conflict.
So in your case it would be charged with someone, and maybe if the person was shouting general things like N word they could be charged with public disobedience or disturbance but doubt it would be a direct charge for what they said.

You are 100% incorrect. The Supreme Court has upheld on many occasions that hate speech is protected speech. What isn’t protected is direct threats of violence or speech that incites violence.
Under current First Amendment jurisprudence, hate speech can only be criminalized when it directly incites imminent criminal activity or consists of specific threats of violence targeted against a person or group. - American Library Association
As the law stands now, government (including public colleges and universities) generally can’t bar hate speech unless it’s direct, personal, and either truly threatening or violently provocative. "Free speech" doesn't mean that you have the right to say whatever you want. It means that you have the right to openly criticise the government without fear of judicial repercussion. It's not relevant to this.

Though even if mentor kicks someone don't they automatically come back? Least that has always been the case when I get removed from NN. Would a kick really solve anything?
Being kicked only ever removes people from NN temporarily regardless of whether they're mentors or sprouts, yes.
I recognized that mostly because those RMT spammers used to try to get invited to NN to spam inthere and kicking them would only shut them up temporarily.
Which is why I suggested cumulative kick duration; first kick for a sprout-30min, second kick 45min, third for an hour, fourth for three hours and so on.
If someone is being disruptive enough to warrant that many kicks it could transition to removal from the Novice network.
That could be heavily abused though. Yeah. There was a mentor in Diabolos' NN for a little while who would troll a couple specific people by kicking them anonymously and immediately leave so they could not be kicked because they did not share this person's views. Before then they would spew all sorts of word vomit in NN and Limsa chats, partly to troll but I also believe that they believed everything they were saying, as messed up as a lot of it was. All of it led to a general dislike of this person, especially within the NN, which led to their dirty tactics toward to the end. Most people were quick to call them out on their BS, myself included. I'm actually surprised I didn't end up as one of their targets. lol I was VERY critical of them. Haven't seen them for awhile though, nor have I heard them mentioned. Kinda wondering if they finally got the ban they deserved. All of this drama and abuse of power just from one person. I'd rather not increase what power mentors have. I say this as a mentor. I've seen things.
