I scalping actually against tos? I was under the impression that it was perfectly ok since it's innevitable that some FCs would close and the owners would like to make some gil back for the plot.

Scalping is against the ToS, as Yoshi-P himself said in an interview one time that charging an exuberant amount of gil above the price of the plot is grounds for reporting.
