    So now you have someone using that leeway to publicly harass another player using their materials. Yeah that's not gonna go well especially on top of monetizing the platform?

    They might be able to get away with "fair use" but in addition to that, copyright protection is actually rather expensive, the easiest way however to get around it is to ban a person using said materials. I mean they do have a right to, and worse if they feel that person is hurting the brand.

    The person that was attacked wasn't exactly being a saint themselves so I honestly don't feel that sorry for them. I find that the Twitch viewer base usually just gets a quick chuckle out of people playing badly, but it's the ones like this individual who get hostile and defensive when someone calls them out for doing low DPS/making mistakes instead of being humble that tend to become subjects of ridicule.

    Just the fact that they were watching the stream makes me feel like they were waiting for a negative response but the streamer was gullible enough to take the bait so that's his problem. The proper thing to do in such a situation is just politely inform the problem player they aren't pulling their weight for whatever reason then just remove them instead of giving them a reason to report you; especially if said player clearly has an attitude.

    The unfortunate thing is they're probably more likely to be attacked by his fanbase now for not just sucking it up and choosing to retaliate instead.

    There have been several cases on here and Reddit of players being suspended for it.

    If you're talking about streaming, you'd have to ask a GM about that. I don't know why you would be concerned with that when there has been one case and it involved actions that affected another player.

    If you want to know if something is allowed, you can attempt to contact a GM to get an official answer. Start to file a report like you would for harassment and ask your question there.
    That's the thing though - Words and language that others might find offensive is such a nebulous thing. To one person, saying "Darn" could be offensive to them, and as i said in an earlier post, some people even get offended by a simple "good morning" - They need to be clearer to what "Offensive language" is - There needs to be a certain level of maturity from players, sure, but when someone can get suspended or banned or even contacted by a GM in the first place for saying "Damnit"...Then thats when the rules need to be clearer.

    It specifically says :REASONABLE PERSON:


    any language that a reasonable person would find offensive.

    A reasonable person will not find darn or good morning offensive.

    A question out of this discussion: has SE ever actually said "we won't accept third-party evidence in any situation" or is that just what people have derived from "we can't accept this video as evidence because we can't verify it"?

    Just remember, everyone, theres a huge difference between a Reddit post, Discord post or screenshot and a VERIFIED live stream.

    SE still won't go after the former because they're easily faked and doctored. A verified Twitch stream is not.

    The STF report form for third-party programs has a field to input a URL. They've never said they won't accept third-party evidence in any form and they never will, as that would tell everyone they could sell anything for real money as long as they direct to a discord. The current crop of clear sellers and Twitch art streams may be aware they can do this, but they're a very small minority.

    Any instances of SE saying they can't accept outside evidence have come from GMs. The STF doesn't respond to the community.

    One of the main reasons developers allows streamers and YouTube channels to use their IP/Gameplay is because it's good advertising as well.

    Onto the topic of fair use, I'll add that it's vaguely not fair use if the person's primary reason is monetary gain. Any developer would have a very good reason to sue and win such a case because 1) the streamer is using the game for monetary benefits as well as 2) the developer can claim that this streamer has the potential to negatively impact their market (however little or big) and as you said "hurt their band". A certain Japanese gaming company is well known for taking down videos on the YouTube because of point 2.

    Fair use is very ambiguous, but from what I hear SE is within their rights to invoke ToS from outside of the game in this instance.

    Have you all heard the story from Yoshi-P about why he doesn't like parsers and won't implement them in game? It's because someone was getting trashed over their dps on a stream. They don't like cyber bullying, guys. And they take it seriously. Don't be a douche in a public forum and you won't have an issue.

    I think its more about him public shaming the blm on stream then the actual parcer itself. From what I've been hearing that the BLM started things with him , in which provoked his response in that matter.

    Not saying that it was an okay to do so.
