From the GM side if you were being disruptive to outside of the party with the argument, the more disruptive would get punished. That's human nature of a police/militant/dictatorship state. From the other side of the coin, I'm not sure why both parties are not punished as SE often states that they will never interfere with the dealings of players between themselves; but when they do its always militant action taken. There judgement and penalty was cast prior to yo going to GM jail. This is the two dogs on a porch scenario. One agitates and the other bites. The agitator, no matter how large or small a role they played, usually never gets punished.

It just works for a statistics assignment I'm currently doing, and plan to tie into an English assignment as well, I'm not creative at all, so all this happened at a time that actually gave me something to base it off of. (At the rate this is going I'm contemplating tying in post of people misunderstanding too. xD )
