Yes you do.

I can confirm you don't have to empty it. Mine is almost full and luckily I did not have to empty it before transferring, so don't worry

You can, however, display items on a mannequin, then remove the mannequin. The items will remain in the "to be sold" inventory of your retainer and will not prevent you from transferring.

So for the move I can leave my house together and change servers to a non-restricted server.. Get my refund and extra 3m gil and then 3 days later return to my original server?

Possibly, as long as you don't relinquish your house/plot before you move and your original server doesn't become congested in the meantime. And you realize that you will lose your plot when you move.
