But with the disclaimer in place, at that point, Square has covered themselves by stating that the player agreed not to, and can deflect the matter to the player performing the copywritten piece. Honestly, I suspect that was the entire point of the disclaimer. Also, unless someone is recording you and then uploads it, the actual act of you playing anything is incredibly unlikely to ever be known or provable by anyone.
