With regards to the ASCII characters, as far as I can tell, they implemented Unicode in it's entirety. This is hardly surprising given the Japanese basis for the game and thus the need to allow the use of kanji. No one is going to sue SE because RMT are advertising, whereas they might if people start playing copyrighted works and posting them.

But with the disclaimer in place, at that point, Square has covered themselves by stating that the player agreed not to, and can deflect the matter to the player performing the copywritten piece. Honestly, I suspect that was the entire point of the disclaimer. Also, unless someone is recording you and then uploads it, the actual act of you playing anything is incredibly unlikely to ever be known or provable by anyone.

That doesn't mean someone won't try to sue anyway if SE doesn't crack down on it. SE has the deepest pockets and so is the most likely target. Also, it's a new feature, SE may be going heavy initially to make sure people are more careful about what they do.
