I'm not really sure why you would feel that you didn't deserve a kick but he did?
Was his response good for the group? No. However the entire issue started from your negligence to the group and then your continued bad behavior by instigating him with the mark.
As some others have said, I don't think you've the right to complain. When you sign up for something your attention should be on the dungeon/raid/whatever when you get into it; not texting.
Could the tank have handled it better? Yes most definitely. However you chose to make it worse instead of simply removing the mark from yourself and just apologizing for missing the boss. If the tank continued at that point, then it would be fully on him. The reason behind your kick over the tanks was likely due to you provoking him into not doing anything, so they probably saw you as the more detrimental one to their group. Just my thoughts on the matter.
As a general rule, I'd be upset over someone missing a boss cutoff because they were texting. When you're playing with other people, it's only polite to pay attention to the game - certainly prioritizing it over something as trivial as a text message. If you DO have to vanish for a period of time, it should be for something important and you should clearly let them know. It's rude to do otherwise.
To be sure, the tank was a bit petty by marking you, but to escalate it in return when you were originally in the wrong (deeply in the wrong, in my estimation), definitely makes it kick-worthy.
I remember this one great time in Final Steps of Faith (8 man) where 2 people were being jerks and blaming the tanks for a wipe, and everyone knew exactly who needed to be kicked- the people who were raging and being salty! We vote kicked them and got new people and went on to clear the content.
There's always a deluded moron with the child attitude of 12 who likes to control things. Just ignore and do the stance again.
The tank was childish for behaving the way he did marking you, but he was right to be annoyed if you were texting and missed a boss. If it is an emergancy sure just quick in /p say sorry important rl thing brb or whatever, do your thing. Everyone is happy.
By marking him every boss fight you antagonised him into doing nothing. You were just as childish as he was. Two wrongs do not make a right, next time, be the bigger man or woman. Ignore the fool and carry on. Or try a vote kick if they are being majorly unpleasant.
