I like the current claim system. I like that you can help someone legitimately in trouble. I like how it will work in large scale PvE content.
I don't like the powerleveling exploits, but that can be fixed in other ways without messing with the claim system.

Only thing wrong with the current claiming system is power leveling. There's literally no point to any content pre-45. They should implement an auto-pilot system because that's what I feel like my brains on when I have do do all of that mind numbing questing/main story. Challenge, Can I have it?
Can also limit who can cure a party? If someone is engaged (maybe just with NMs or HNMs), you can only cure them if in party or raid group? This would negate your suggestion. It does mess up the future of open world content the way it is now, you cannot deny that. The way the claim system is right now, there is really no way to balance open world content, so the devs have to make instanced content.As far as the claim system goes, it really is just fine. Sure, it could use a few tweaks (the drop PL thing being one of them), but it works otherwise. As for it messing up open-world content, I'm inclined to disagree. Even if you couldn't attack other people's claims, you could still fill a party with DDs and keep the healers in a second party, which is pretty much a zerg-fest.
As for party size, it's currently not one of the top priorities, nor should it be. This game needs to work well with 8 man groups before it will ever be great with 16, 24, or 32 man groups. As such, the Dev team is taking the right approach in making content for 8, and limiting groups to that size for the time being. The time will come for content designed for more people, but there is still a lot to do before the game gets to that point. It is unfortunate that it was so deeply flawed at launch, because the player community is ready for large-scale challenges, but the game is not.
The only thing the 8-man party setup is working well with right now is instanced content. Anything else is not balanced at all. You can go into a stronghold with 50+ people and zerg, sound balanced? Nope. I am not saying the 8-man party size is wrong, in fact, i like it. I am saying when you have more people outside the party fighting your mob is when it becomes a problem for strategic fights and what not.

I think it's fine. Pretty awesome that anyone can help beat down the mob at any point in the fight. Only thing that makes me a sad panda is the ease of PLing.
Ya, no one is denying that. Though "zerging" orwhatever people call it, is a problem, that is why I think if they make NMs one party target(including alliances). That would be cool.
