They do server maintenance at the same time as the patch...what part of that do you people not get? They can't do server maint is the servers are being hammered with patch download requests...

Ideally the patch server should be sitting completely separate from the game servers; anything else is bad infrastructure. That way they can do maintenance on the patch server, make sure it's in mint condition, turn off the game, and do maintenance on the game servers while everyone hammers the patch server to get their clients up to date.

Do you? Do you genuinely doubt this? Has anything they have done in the past with servers led you to believe they have an actual real-life-comparison testing environment?
As someone already said: patch server != game servers. No reason to have patch server down for the duration of game server maintenance. Although the weirdest thing is you think somehow server maintenance is affected by patch downloads. That REALLY would be some epic server design feck-ups: we're talking junior dev mistakes here.
