No, it doesn't. The Terms of Service allow SE to ban you for explicit chat, and they will, but you'll only get banned for it after it's occurred, which means some children may already have seen it. That disclaimer just prevents SE being sued by parents because an infraction of the rules occurred before the offender was banned for it.
Banning is an after-the-fact reaction. SE doesn't have the ability to actually prevent the offence from occurring, so they don't want to be legally liable for it.
