You're right about consistency, however you're wrong about Yes being first. If Yes is first it will be chosen accidentally constantly and no that isn't okay for whatever elitist reasoning you've brought to bear. If we always wanted to pick Yes, there would be no reason for a Yes/No confirmation to begin with.
