Pretty much this, it's literally impossible to kick the dishonest person if multiple people don't speak up, as you wouldn't know who it was. It is actually a reportable offence too, but I doubt many people go that far and I also doubt SE act upon it.ToS under [player agreements it falled under trade and verbal player agreements. When you join a party with rules you agree to adhere to those rules, breakiing said rules means you break the agreement. And its hard to simply kick the offender as they don't fess up, and cause parties to disband due to blame game on who broke the rules.
