    It was announced 2 months before launch that Ragnarok would be the recommended server for Legacy players from Europe.

    You were already given multiple chances to transfer to the EU Servers. You had a 4 week period in P3 of the beta - which waived all the current transfer restrictions, and then there was another week of free transfers in the October after launch to help friends get on the same servers.
