SE are allowed to charge whatever they want in each individual EU member state, so the £129 and €129 is perfectly legal. What is in question is if they can legally block (or prevent) a person from one member state (the UK) purchasing from another member state (the Eurozone). If it is illegal, then the EU could simply instruct SE to rectify the issue (no good for us currently), but they can also fine (I think it's up to 10% of their global revenue, so $1.2b. They fined MS a heck of a lot and $1.5m per day for non compliance with a directive)
