yeah unfortunately this is a small design oversight intended to allow people to acquire extras to sell if they so chose (especially things like nutkin or fat cat and the like that are the result of things you can/must do solo and are exceptionally rare)
It's kind of annoying, but the flip side is it allows people to have one but still get another to sell so someone else can get it. Those without the proper classes on retainers, for example, wouldn't be able to get the fat cat any other way.
They'd have to come up with a new item tag to prevent this

That should be what the unique and untradeable tags do, but by using a specific mount/minion ability granting item you no longer have the item making it so that you can claim another.

The problem is that there are some OTHER items that are unlockable, unique, and untradeable that you need to get over and over. They'd need to create another tag.

More willing to bet it's more of the same BS where instanced player data simply does not have access to the player mount and minion lists for server stress issues so they can't even run a check against it even if they wanted to.

Mind you, I think most of us would pay attention to certain items of rarity (like the mounts), but it can happen.
And why even allow such a scenario? It beggars the question why they implement systems like this with margin for human error.

My sentiments as well shougun, seems like an oversight
