Export Combat log into Excel and bam you can now effectively parse an instance without a parser.no dear.
A third party tool is ANY software that interacts with the first party program that isn't officially sanctioned and created by the first party. Parsers read information that is logged by the first party (the game) but allow you to then use that logged information in a way that is not usable by those without the parser.
It's third party, no matter how you swing it. Don't be naive about these things, if you're using a parser, don't talk about it. fight club.

Use ACT, heaps better than FFXIVAPP.
And considering Lucrezia, DnT, Collision etc all use them in their world first video's which I am sure SE have watched, nothings gonna happen as long as you don't use it to abuse people.

FFXIVAPP is pretty bad. Go for ACT.
As far as against ToS: SE can't really do anything about it. I hope 3.0 will have SE's parser.

Big thing people are leaving out here. FFXIVAPP and ACT are more than just parsers. Using it as just a parser is fine, just don't grief another player over his/her DPS, although there are ways to determine if a player is doing well or not without one.
Using these applications with their trigger commands is illegal. Can see it in DnT's T13 kill, as well as many other videos from back in the first coil when they are used to call out Twisters. At this point, the application is doing some of the work for you.
