Random Crashing

I'm getting random crashing a little after upgrading my graphics card from a gtx 460 to an asus gtx 970 - the error listed being BEX 0a9e. My 460 never had problems and it may well might not be the 970's fault either but nothing else has changed on my rig. I've done everything short of reinstalling windows; clean install graphics driver, roll back drivers to all sorts of versions, reinstalled game, remounted ram, compatibility for xp, run as admin, can't make the program a DEP exception unfortunately, reinstalled dx9, etc. Nothing has stuck. Have waited and waited for some patch from either square or nvidia to save me but so far no patches have fixed the problem. The worst part is it's seemingly completely random, sometimes when in a dungeon, sometimes when just standing there, sometimes immediately after logging in, sometimes after only 10 minutes, or like today where I left the game idle in mor dhona on max for 8 hours and never had a crash. It's driving me up the wall, any ideas?

I tried updating my bios and so far so good, no crashing. Hopefully it's fixed (knock on wood), but will post here again if it turns out to be a fluke.
FPS is still abysmal at times though.

Do not set DEP exceptions, by doing this you turn DEP on for every program, including those that are not compiled to actually use it.
