why are we not allowed to download the update yet?

I didn't say I knew how to do it, but everything is possible on the internet.

If it were possible to grab the patch files whilst they were being updated through the maintanence then the source to get them from would be widely known, even then it'd be restricted via direct access, I've run multiple scans on where the Launcher calls when querying updates and they're all restricted if you try to access them manually.

It's not uncommon for glitches to occur during implementation, requiring a little tweaking here and there. If they are minor fixes, the already compiled main patch file may get released and then minor updates could follow... but if it requires large enough changes they may opt to wait for them to test that the core update is more stable and recompile in an effort to reduce some of the follow up down time.

I'm hoping it's a case of the latter. I'd much rather wait a little longer to get the bulk of the update up front in one shot instead of a constant flux of minor updates every 24-48 hours over the next two weeks. We've all experienced enough of that recently.

true, but i also don't want to wait to install the update at the last moment and get into a bottle neck mutli hour long download war for the patch.

Periodically, 7-Zip or WinRAR compilations of the updates get posted at places like bluegartr and such. They may be considerably smaller with the .7z/.rar compression... not sure, as I haven't used the downloads for XIV yet, but it was true for the XI ones they would put up.

The patch notes still say preliminary, so I want to say that they don't want people data mining throughout the night and having an advantage over others. While I could see not being able to download the patch now (if you have a slower connection) could be an inconvenience for some, there is probably a good reason why they are not allowing the update/download at this time.

Using a P2P technology like Bittorrent could alleviate this problem immensely. This should be optional, centralized server is expensive and complicated. Just sayin'.
