Not sure how SE write their code, but I would guess that every instance that was create, it also generate some type of ID together with it. Technically, you can tie the character ID with the instance_ID to prevent the guy who got kicked to join back to the previous session/instance.

@monochromicorn, in your situation, cant you just leave the instance and join back as different class? (since the instance you in doesn't have the full/light party , leaving instance will not give you any penalty.)
