Why have Vote Kick if it's almost entirely abused?

The system does get abused a lot, because there is generally no risk involved. There have been many times I've been in a dungeon and the "Vote to Kick" popup shows to request my vote, for no legitimate reason that I could tell. So I simply cast my "No" vote and hope it ends there. Unfortunately, it usually doesn't, as the chatwar then begins.

Perhaps if when a person is kicked, the DF doesn't begin searching for a replacement for 5 mintues would be a deterrent. People might think twice about kicking if the party member can't be replaced quickly.

The whole point behind kicking someone out is that you want to replace the troublesome member with someone who isn't a jerk ASAP. Using your idea, I could troll people and there would be nothing they could do about it unless they want to take a forced 5 minute or more break waiting for a new member to replace me.

You just mentioned a legit reason to kick someone. Which would be worth waiting 5 minutes to take care of it, in my opinion. However, waiting 5 minutes because "I don't like his gear" or "he's not a synced 50" or that kind of thing would not be worth it.

On top of what Miles is saying in the post above mine, a 5 min kick penalty is pointless. It would absolutely cause more harm than good. People who are truly willing to kick someone for such inane and/or asshole-ish reasons (i.e. "I don't like his gear", etc) are not going to be phased by a 5-minute penalty. They're going to do it anyway. So all it would do is force people who kicked for legit reasons to wait.

The only way to make it sting for "bad kickers" would be to make it much more than 5 minutes... which would royally screw over people who kick for legit reasons and then have to wait out the penalty (ON TOP of waiting for the replacement, if the jerk that got legit kicked wasn't DPS).
