The thing you have to remember, is that person alone cannot kick you. He can initiate the vote, but others have to agree to do so. It basically boils down to majority rules.My apologies then. But this does raise an issue. Example: if you (for whatever reason) join a duty via duty finder on a class, someone in your party say "woah, why are you using a class?" Then you shortly get kicked, what then? Was it justifiable? That person couldn't really switch jobs if he could, right? So did he deserve the kick? Should the person who initiated the kick be penalized?
