So, let me get this straight. . .

1) Somehow get everyone except the bad DPS to agree to reform after "breaking."
2) Make some excuse to "disband." IOW, tell a blatant lie.
3) "Disband" the party.
4) Re-invite everyone but the bad DPS.
5) Put the party back into PF to replace the bad DPS.
6) Pray that he doesn't see the party listing.
7) Have some sort of excuse ready in case he does see the listing.
8) If he manages to rejoin the PF, be prepared to explain this entire sordid chain of events.

Now, why would I do all of this (to include conspiring and lying) when a simple "Hey, man, your performance isn't good enough. We're going to have to replace you." would be so much simpler? Oh, and of course this doesn't work at all in Duty Finder, only in Party Finder.
