[DEV] ToS question I'd like clarification on

I read in the ToS and noticed this part
"3.5 Naming Right. You may not use any name or other intellectual property belonging to Square Enix or any other third party in your use of the Game (for example, naming a character after a celebrity, company, product, or superhero)."
Does this include Anime characters? I have seen characters with Anime characters names and was wondering if it was also included as a ToS violation, if not I may make one based on one of my favorite characters.

As for anime characters, it depends. If its a name thats mostly used in various animes, then its not intellectual property. Im sure we can find at least 30 different animes where they have characters named, lets say, Sora, for example.

Now, if its a name thats basically iconic and used on one specific media, like Super Sonico, or Naruto Uzumaki, then yes, it is a breach of 3.5

lol I can count on both my hands,feet my Wife's hands,feet and our dog's toes the anime names just from bleach and nauto but were wanting to make sure it's not against ToS to use lets say Sailor Moon or Hello Kitty for example (Both taken on on our server)

Based on the 40+ variations of "Scarlett Johansson" a quick search brought up, I'd say you're safe using an Anime name.

Ah, let me clarify then. My eyes get a little blurry seeing the same thing over and over, but I think I count 36 instances of that EXACT name.

This rule is very lightly enforced and exists mostly so that SE can protect itself. Yes, technically the Naruto Uzumaki on every server is violating the ToS. There's just no actual reason for SE to care unless the people who own Naruto complain.
